The Department of Education, State Office of Special Education (SOSE), provides notice to all interested parties, parents, and all public and private agencies providing publicly funded special education services to eligible children with disabilities pursuant to the Individuals with Disabilities Education Act (IDEA) in the Virgin Islands of its intent to promulgate PROPOSED SPECIAL EDUCATION RULES pursuant to 17 V.I.C § 292 and 34 C.F.R. § Part 300, and PROPOSED NOTICE OF PROCEDURAL SAFEGUARDS pursuant to 34 C.F.R. § 300.504.
The Department shall from time to time amend and revise, rules and regulations necessary for the implementation of the IDEA, federal regulations and Territory laws as needed. Amendments to the Special Education Rules are authorized by the Virgin Islands Code, 17 V.I.C § 292. The 2007 Nadine Jones Consent Decree, paragraph 20, authorizes necessary changes to be in conformity with the IDEA. The PROPOSED SPECIAL EDUCATION RULES ensure compliance with the IDEA. The PROPOSED NOTICE OF PROCEDURAL SAFEGUARDS amendments is in conformity with the IDEA.
